Terms of Service: Product Purchases

By purchasing any products (“Goods”) from Expand A Shed ABN 52 653 143 947 (“Expand A Shed” or “we”) on this website, you agree to be bound by the following conditions.

1. It is your responsibility to ensure that all information provided by you regarding your quote request is complete, accurate, and up to date.
    

2. If you select delivery during the shed customisation process, you must pay for delivery in addition to the price of the goods. You have the option to use our delivery service (which will be quoted separately), or you can arrange your own transport using a tilt truck.
    

3. We will endeavour to ensure your delivery arrives on time, however, we will not be liable if the delivery of your goods is delayed for any reason.
    

4. It is your responsibility to ensure that the shed you purchase from our website is appropriate for your property/space. We accept no liability for the costs associated with ordering an incorrect product.
    

5. It is your responsibility to notify Expand A Shed (prior to delivery) if there are any safety hazards or obstacles that may prevent or hinder delivery. If the delivery site is unsuitable or unsafe for delivery, the delivery driver may (at their absolute discretion) refuse a delivery. We accept no liability for the cost of a re-delivery under these circumstances. Otherwise, additional fees may be charged to the customer to ensure the delivery can be completed safely.
    

6. If you organise your own delivery method, you agree to accept all liability for any damages associated with that delivery. Expand A Shed will not be liable for any loss or damage caused to the shed, other persons or property as a result of a third party delivery service.
    

7. We will not be liable for any damage, loss or theft that occurs to your products after the delivery (or pick-up) is completed.
    

8. All of our sheds come with a 2-year structural warranty. If you make any attempt to modify the shed, this warranty will become void. Placing a shed on a surface that is not level will also void the warranty.
    

9. All other warranties and representations, except those which are non-excludable in law, are excluded. If the Goods are defective or do not meet these warranties, we will refund the price or repair or replace the Goods. We exclude liability for indirect or consequential loss. We will not be liable if you have failed to follow instructions, modified the goods or used them for an unintended purpose.
    

10. The products shown on this website are graphical representations of the products we have available for purchase. You, therefore, agree that product characteristics such as colour, shape and size may vary when comparing these online images to the physical products. We cannot guarantee that your computer monitor's display of any colour will be accurate.
     

11. All prices on this website are inclusive of Goods and Services Tax.
     

12. Prices for our products and services are subject to change without notice.
     

13. We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction.
     

14. Once we send you a quote, that quote will remain valid for 28 days. On the 29th day, the quote will become invalid and you will be required to submit a new request. 
     

15.  You will be required to pay a 50% non-refundable deposit upon acceptance of the quote before we will commence work on your shed. Acceptance must be in the form of writing.
     

16. Expand A Shed reserves the right to alter product specifications or pricing, correct any errors, or withdraw products from a quote at any time, without notice.
     

17. It is your responsibility to ensure that you have council approval to place a shed on your property.
     

18.  We do not offer refunds for change of mind, or if you incorrectly ordered. If a received product is not as stated, defective or damaged, please contact us. If you can provide satisfactory evidence that the product has a major fault you may reject the product and seek a refund or exchange. In the event of a return, you will be liable for the cost of return delivery. Refunds will be issued using your original payment method. If a debit or credit card was used, then the cardholder and the same card must be present to complete the transaction.
     

19. These conditions are governed by the laws of the State or Territory in which the Goods are supplied. Expand A Shed and you submit to the non-exclusive jurisdiction of the courts of that State or Territory.
     

20. To the maximum extent permitted by law, you indemnify and forever hold harmless Expand A Shed from all liability (however so arising, including as a result of negligence, and including any loss, claim, damage, demand, injury or death and a fine or penalty imposed by a statutory or other authority) caused or contributed to by your negligent act or omission or any breach of these conditions, or otherwise arising from Expand A Shed supplying the Goods in accordance with these conditions. You will not be liable under this indemnity to the extent the relevant liability arises from the negligence or wilful default of Expand A Shed.
